A suspect was shot and killed during an exchange of gunfire while attempting to rob a cell phone store Tuesday evening in Chicago’s South Side, the Chicago Tribune reported.

Authorities stated that 25-year-old Demarcus Brandon entered the cell phone store about 6:30 p.m. Brandon was armed with a handgun, but so was the store clerk. Although details are a bit scarce, authorities confirmed that there was an exchange of gunfire between the two, although it’s unclear who fired first.

Bullets from the clerk’s gun struck Brandon, who was later pronounced dead at the scene. Police also found a handgun, which they believe belonged to Brandon.

The clerk was not injured during the ordeal, but according to police another man inside the store broke his ankle while attempting to flee the area as the gunfire erupted.

According to Illinois Department of Corrections and Cook County Court records, Brandon was paroled over the summer after serving a portion of concurrent 3-year and 13-year sentences.

Brandon was charged with armed robbery with a firearm, armed violence, aggravated unlawful use of a weapon, gun possession, aggravated fleeing from police and having either a rifle with a barrel less than 16 inches or a shotgun with a barrel less than 18 inches, resulting in the 13-year sentence.

Both cases ended in plea deals, but in the end Brandon only served about half the time he was sentenced.

He was also due to be discharged from parole in July 2016.

It is unknown if the store clerk’s gun was legally owned or whether he had a valid Firearm Owners Identification card. A FOID card is required to legally possess a firearm in the state of Illinois, which incidentally was the last state in the country to recognize residents’ right to bear arms outside of their home or business.

No charges have been filed against the store clerk, but the incident remains under investigation
