NJ Murphy Administration Tries To Kill Rifle Club Right To Carry Lawsuit

Anticipated Motion to Dismiss Helps Set Stage for Future High Court Battle.

New Jersey – -(Ammoland.com)- The Murphy Administration has filed an anticipated motion to dismiss Association of New Jersey Rifle and Pistol Club’s federal court challenge to New Jersey’s unconstitutional carry laws, which deny ordinary law-abiding citizens the right to defend themselves with a firearm outside the home. A motion to dismiss asks the court to throw out the case without trial or any further proceedings.

Carry laws such as New Jersey’s, which require permit applicants to prove “justifiable need,” were held to be flatly inconsistent with the fundamental, constitutional right to keep and bear arms by the U.S. Court of Appeals for the D.C. Circuit.

We believe that this view will ultimately prevail, but not before the issue is taken up by the U.S. Supreme Court. Until then, we anticipate that the lower and middle federal courts covering the Garden State will issue rulings hostile to right to carry, as they have in the past.

“Our goal is to take this case all the way to the U.S. Supreme Court, where we intend to correct erroneous precedent and establish, once and for all, that the Second Amendment protects the right of ordinary, law-abiding citizens to defend themselves with a firearm outside the home,” said ANJRPC Executive Director Scott Bach.
