The parents of Michael Brown, the 18-year-old who was shot and killed by Ferguson police officer Darren Wilson last August, filed a wrongful death suit in Clayton, Missouri, Thursday against the City of Ferguson, former police chief Thomas Jackson and Wilson.
Jackson and the city were named because, according to the complaint, “they cultivated the mindset” which contributed to Brown’s death.
“The bottom line is simply this….Officer Darren Wilson did not have to use this deadly force on that Saturday afternoon,” said the family’s attorney, Benjamin Crump, during a news conference. “We do not believe, based on the forensic evidence and the narrative given, that Michael Brown should have been killed.”
The lawsuit also alleges that Wilson shot Brown while his hands were “raised in a non-threatening manner,” although the Justice Department previously found “no witness who has stated that Brown had his hands up in surrender whose statement is otherwise consistent with the physical evidence.”
Likewise, Crump asserts that all of the evidence was not thoroughly reviewed.
Brown’s family is seeking at least $75,000 in addition to compensation for punitive damages and lawyer’s fees.
